# Terms of Service

Please read these terms carefully before using Anima Felix.

## 1. About Anima Felix

These Terms govern your use of the Anima Felix app, website, and related services. The service provider is Anima Felix SRL (“Anima Felix”, “we”, “us”), a limited liability company with registered office in Bucharest, Ion Mihalache 166, Sector 1, Romania, registered in the Trade Register under no. J2024027531000, with fiscal code 50637957.

The Application provides an innovative digital platform that integrates technology with mental health practices, supporting individuals in monitoring and enhancing their overall well-being. The services and functionalities are exclusively intended to support users in their self-development journey and are not, under any circumstances, a substitute for medical diagnosis or clinical intervention.

## 2. Eligibility

You must be at least 16 years old, or have reached the age of majority applicable in your jurisdiction, to use Anima Felix. If you are under 16, you must have obtained the necessary consent from a parent or legal guardian. If you do not meet these requirements, do not use the service.

## 3. Service scope and important safety notice

Anima Felix is a wellness companion focused on anxiety support and self-management tools. It is not a medical device, not a licensed therapist, and not emergency care.

If you are in immediate danger, contact local emergency services. In the United States, call or text 988.

## 4. Your account responsibilities

- Provide accurate account information.
- Keep your login credentials secure.
- You are responsible for activity performed through your account.
- Notify us if you suspect unauthorized access.

## 5. Acceptable use

You agree not to:

- Use the service for unlawful purposes.
- Attempt to gain unauthorized access to systems or data.
- Disrupt, abuse, reverse engineer, or misuse the service.
- Upload or transmit harmful, illegal, or malicious content.
- Infringe intellectual property or privacy rights.

## 6. AI-assisted outputs

Some features use AI-generated outputs for educational and wellbeing support, including chat responses, exercise recommendations, assessment interpretations, and content moderation. AI outputs may be imperfect and are not medical diagnosis, therapy, or treatment advice. You acknowledge that the Application’s tools and content are designed for informational and self-improvement purposes only. You remain responsible for decisions you make based on app content and for consulting a qualified health professional for any questions regarding your mental health.

## 7. User content

You retain rights in the content you submit. You grant Anima Felix a limited license to process, store, and display that content solely to operate and improve the service in accordance with our [Privacy Policy](/privacy/).

## 8. Intellectual property

The Anima Felix brand, software, design, and service content are protected by applicable intellectual property laws. You may not copy, distribute, or exploit them except as permitted by law or written consent.

## 9. Subscriptions and payments

Access to basic features is provided free of charge. Optional paid subscriptions provide access to additional functionalities. Subscription details, pricing, and billing periods are displayed within the app prior to purchase.

Subscriptions renew automatically at the end of each billing period. You may cancel at any time through your app account settings. Upon cancellation, access continues until the end of the current billing period. Payments are processed through authorized third-party payment processors (RevenueCat, Stripe).

Except as otherwise required by law, all fees are non-refundable.

## 10. Third-party services

We engage third-party service providers and subcontractors to support the provision of the app (see our [Privacy Policy](/privacy/) for the full list of processors). We are not responsible for third-party services, compliance, or actions. Access to third parties via the app does not imply endorsement by Anima Felix.

## 11. Availability and changes

We may update, modify, suspend, or discontinue features to improve safety, reliability, or legal compliance. We may also update these Terms by publishing a revised version on this page.

For material changes - especially those affecting data processing purposes, legal bases, or special category data handling - we will provide at least 30 days’ advance notice (via email or in-app notification) and require your affirmative consent before the changes take effect. If you do not consent to a material change, you may stop using the service and request account deletion.

Non-material changes (e.g. clarifications, formatting, or updates that do not alter your rights or obligations) take effect when published. We encourage you to review this page periodically.

## 12. Suspension or termination

We may suspend or terminate access for violations of these Terms, abuse, security risks, non-payment, extended inactivity (12+ months), or legal reasons. Where possible, we will provide prior notice and an opportunity to remedy any breach.

You may stop using the service at any time and may request account deletion via [Delete Account](/delete/). Upon termination, you may have up to 30 days to export your data before it is permanently deleted.

## 13. Disclaimer and limitation of liability

The service is provided on an “as available” basis. To the maximum extent permitted by law, we disclaim implied warranties and limit liability for indirect or consequential losses.

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

## 14. Governing law

These Terms are governed by Romanian law, without prejudice to mandatory consumer protections under applicable law.

## 15. AFK peer-support features

In addition to the main Anima Felix app, we operate a separate mobile app called **AFK (Anima Felix Key)**. AFK is published under its own App Store and Google Play listings but is provided by the same legal entity and is governed by these Terms. Because AFK is built around user-to-user messaging, the provisions below apply in addition to — and, where they diverge, in place of — the general rules above.

**Peer-to-peer content vs. self-service AI content.** The main Anima Felix app is primarily a self-service experience: content you see is either authored by us or generated on your behalf (for example, by the AI chat or by exercises you complete). AFK is different. On AFK, askers receive replies that are primarily written by other users (peer replies). The rights, responsibilities, and moderation approach that apply to peer content differ from those that apply to AI-generated or editorial content, and the sections below set out how.

**Asymmetric visibility.** Users who submit a support request on AFK appear to other users as fully anonymous. Users who reply as supporters are shown to the asker with only their first name and a country flag derived from their account region. When you reply as a supporter, you understand and accept that your first name and country flag will be shown this way — this visibility model is how the AFK peer-support feature functions, and processing is on the basis of Article 6(1)(b) GDPR (performance of the service you signed up for). You must not attempt to deanonymize an asker, share external contact details with them, or otherwise route an AFK conversation off-platform.

**Request lifecycle.** Each AFK support request automatically closes after 30 minutes or once 10 replies have been received, whichever comes first. Once a request is closed, no further replies can be submitted to it. The request and the replies you received remain in your reply history inside the app until you delete your account or request deletion under these Terms and our Privacy Policy.

**Safety control — Reported.** Askers can mark any reply as **Reported**. Reported is the single shipped safety control on AFK. There is currently no separate feature to block a specific supporter, and these Terms do not promise one. Content that is marked Reported is reviewed by our moderation team and may be removed from user-facing surfaces; the underlying record may be retained as safety evidence as described in our [Privacy Policy](/privacy/). We may also suspend or terminate the account of a user whose content is repeatedly or seriously Reported, under section 12 of these Terms.

**Reply sources and synthetic fallback responses.** Replies to an AFK support request can come from two sources: most replies are written by other AFK users, and the AFK backend currently includes a fallback response system — a curated bot-response system operated by Anima Felix using internal bot accounts with curated reply content — that may deliver a synthetic reply when peer responses are insufficient or slow to arrive. Fallback responses are processed for the same purpose as peer replies (delivering a response to the asker) under the rules set out in our [Privacy Policy](/privacy/). Like the other system-generated outputs described in section 6, synthetic fallback replies are informational and supportive in nature and are not medical advice, diagnosis, or treatment; the disclaimer and limitation of liability in section 13 apply to them in full. We describe this here so you are not misled about where an AFK reply may come from. If this fallback behavior is changed or removed in the future, these Terms will be updated accordingly.

**Community conduct when giving support.** When you write a reply as a supporter on AFK, you agree to the following minimum conduct standards. These are in addition to the general acceptable-use rules in section 5.

**If at any point you believe a user is in immediate danger, mark the message Reported and refer them to emergency services or the crisis resources in the site footer — this is the single most important rule.**

- Be honest, warm, brief, and humble. Write as a person, not as an authority figure.
- Do not attempt to "fix" the other person, provide clinical advice, or diagnose them.
- Do not attempt to act as a crisis counselor.
- Do not use AFK to promote religious, political, or ideological positions, or to pressure another user into adopting your views.
- Do not make romantic or sexual approaches toward an asker.
- Do not share personal contact details (phone number, email, social accounts, external chat usernames, meeting links) or request them from the asker.

**What AFK is not.** AFK is a peer-support app for anxious moments. It is **not** therapy, not crisis care, not a medical device, and not a meditation timer. Replies on AFK — whether written by other users or generated by the backend fallback system described above — are informational and supportive in nature, and do not constitute medical advice, diagnosis, or treatment. If you are in immediate danger, contact local emergency services. In the United States, call or text 988.

**Your content on AFK.** The general user-content rules in section 7 apply to text you submit through AFK, including both requests and replies. You grant us a limited license to store and display that content so the service can function as described above — in particular, so a reply you write can be shown to the asker who received it (and remain in that asker’s reply history) even after you later delete your own account. Deletion of account data is handled under section 12 of these Terms and in our [Privacy Policy](/privacy/).
